Usage note. Specific Terms applicable to the registration, renewal and management of domain names, as well as to the associated DNS management. To be read alongside the General Terms and Conditions of Kimoun (common trunk). This document replaces the previous “Domain Name Registration and DNS Management Terms and Conditions” version of 9 May 2026, as part of the restructuring of Kimoun’s contractual framework. To be reviewed by a lawyer or legal counsel before publication.
Article 1 — Purpose and scope
1.1 Services covered
These Specific Terms (hereinafter “ST”) govern the Services related to domain names and DNS, including:
- domain name availability searches;
- initial domain name registration;
- domain name renewal;
- routine administrative and technical management of a domain name;
- DNS configuration and modification of DNS records;
- management of DNS servers or DNS zones;
- activation of DNSSEC when available and compatible;
- standard support relating to domain names and DNS.
Services not expressly provided for in the Quote, registration order or these ST are excluded. An indicative list of excluded services is set out in Article 9 below.
1.2 Eligible audience
These ST apply exclusively to professional Clients within the meaning of Article 2 of the General Terms and Conditions of Kimoun (GTC). They do not apply to consumers within the meaning of the French Consumer Code.
The Client declares that it is contracting for the purposes of its professional, commercial, artisanal, liberal, associative, institutional or administrative activity.
1.3 Articulation with the General Terms and Conditions of Kimoun
These ST supplement the General Terms and Conditions of Kimoun (GTC), which remain applicable for all universal provisions (identification, confidentiality, GDPR, force majeure, subcontracting, assignment, applicable law, jurisdiction).
In case of contradiction between these ST and the GTC, these ST shall prevail, pursuant to Article 3 of the GTC.
Article 2 — Specific definitions
In addition to the definitions in Article 2 of the GTC, the following definitions apply:
- Domain name: identifier attached to an extension (for example
.fr,.com,.net,.org,.eu), used in particular to identify an internet address. - Registry: body responsible for the technical and administrative management of an extension.
- Registrar or registration office: provider accredited or authorised to register domain names with a registry.
- Reseller: provider offering domain name registration, renewal or management services through one or more registrars.
- Registrant: natural or legal person declared as the holder of the domain name with the registry or the registrar.
- DNS: system enabling the association of a domain name with technical services such as a website, server, email address or application.
- DNS zone: set of DNS records associated with a domain name.
Article 3 — Kimoun’s role
Kimoun acts as a technical service provider, reseller and management intermediary for domain names. Unless expressly stated otherwise, Kimoun is neither a registry nor necessarily an accredited registrar.
The effective registration of a domain name may be carried out via one or more registration offices or third-party providers, depending on the extension, availability, technical constraints, prices, service continuity and applicable rules.
Kimoun may work with several registrars and may change registrar or technical provider when necessary or useful for service continuity, security, renewal, management or optimisation.
The registrar effectively used for a domain may be communicated to the Client upon request, in the order confirmation, in the registration order, or by any other written means.
Article 4 — Rules of registries, registrars and extensions
The Client acknowledges that each domain name is subject to:
- the rules specific to the extension concerned;
- the rules of the relevant registry;
- the rules of the registrar used;
- the applicable policies of ICANN for the relevant extensions;
- the rules of AFNIC for the extensions managed by AFNIC, in particular
.fr,.re,.yt,.pm,.wf,.tf; - any applicable eligibility restrictions;
- the applicable verification, suspension, blocking, transfer, dispute or deletion procedures.
These rules may evolve independently of Kimoun.
The Client accepts that Kimoun cannot guarantee the maintenance of a domain name when it becomes contrary to the rules of a registry, registrar, administrative authority, judicial decision or applicable procedure.
Article 5 — Order and validation
Any order must specify at least:
- the requested domain name;
- the duration of registration or renewal;
- the identity of the Registrant;
- the necessary administrative contact details;
- the expected DNS services;
- the price or the reference to the corresponding Quote;
- any applicable specific terms.
Kimoun may refuse an order that is incomplete, inconsistent, fraudulent, technically impossible, legally risky or contrary to applicable rules.
Kimoun may request any supporting documents necessary for the validation of an order, in particular where the requested extension imposes specific eligibility or verification conditions.
Article 6 — Availability, registration and ownership
6.1 Availability and effective registration
Any information on the availability of a domain name prior to ordering is provided for indicative purposes only.
A domain name is only considered as registered after effective confirmation of its registration by the registrar or the relevant registry. Kimoun does not guarantee that a domain name available at the time of the request will still be available at the time of effective processing of the order.
In case of unavailability of the requested domain, Kimoun may offer the Client a variant, another extension, another domain name, or the cancellation of the order concerned.
6.2 Ownership
Unless otherwise indicated in the registration order or the Quote, the Client is designated as Registrant of the domain name. Kimoun acts as a technical and administrative service provider on behalf of the Client.
The Client is solely responsible for the accuracy, truthfulness and updating of the information provided for the registration or management of the domain name.
Any error, omission, false declaration or failure to update may result in suspension, blocking, deletion or loss of the domain name, without Kimoun’s liability being engaged if the error is attributable to the Client.
Article 7 — Responsibility for the choice of domain name
The Client is solely responsible for the choice of the domain name.
Prior to any order, it is the Client’s responsibility to verify that the requested name does not infringe the rights of third parties, in particular a trademark, a corporate name, a trade name, a sign, a patronymic name, a copyright, a personality right, a geographic right or any other protected right.
Unless a specific service has been expressly ordered, Kimoun does not carry out any legal anteriority search. A technical availability search does not constitute legal validation.
The Client indemnifies Kimoun against any claim, formal notice, action, proceedings, costs or conviction resulting from the choice, registration or use of the domain name.
Article 8 — DNS management and propagation
8.1 Scope of DNS management
Kimoun may provide DNS configuration and management of the domain name according to the scope set out in the Quote or contract, including:
- creation or modification of A, AAAA, CNAME, MX, TXT, SRV or similar records;
- pointing to a website or server;
- configuration necessary for email services;
- addition of verification records requested by third-party services;
- activation of DNSSEC when available and compatible;
- standard support for DNS modifications.
Any DNS intervention is carried out on the basis of information provided by the Client or by its providers.
8.2 Propagation and technical availability
The Client acknowledges that DNS modifications may require a propagation delay independent of Kimoun. During this delay, certain services may be partially or temporarily unavailable. Kimoun does not guarantee a fixed DNS propagation delay.
Kimoun shall not be held liable for interruptions or malfunctions resulting from:
- normal DNS propagation;
- an external DNS cache;
- a misconfiguration by a third-party provider;
- a failure of a host, registrar, registry, DNS provider, email provider or third-party service;
- an erroneous instruction from the Client;
- a modification requested by the Client.
8.3 DNSSEC
DNSSEC may be activated when the extension, registrar, registry, DNS servers and technical configuration allow it.
The activation, deactivation or improper coordination of DNSSEC may result in a temporary interruption of DNS resolution. When DNSSEC is used with third-party providers, the Client must ensure the consistency of the necessary keys, signatures and records.
Kimoun shall not be held liable for an interruption resulting from improper coordination with a third-party provider or from incorrect information provided by the Client.
Article 9 — Excluded services
Unless expressly provided for in the Quote or contract, the following services are excluded from the standard scope and may be the subject of a separate Quote:
- legal anteriority search;
- trademark filing or monitoring;
- domain name dispute management;
- extrajudicial or judicial proceedings;
- restoration after expiration;
- recovery after deletion;
- complex transfer;
- complete email migration;
- web hosting;
- website creation;
- data backup;
- email service provision;
- urgent intervention;
- on-call service;
- security audit.
Article 10 — Renewal, expiration and transfers
10.1 Renewal
The domain name is registered for the duration indicated in the Quote, the registration order or the order confirmation.
Renewal is not automatic, unless otherwise agreed in writing or under a specific offer expressly provided for. To be guaranteed, any renewal must be requested, validated and, where applicable, paid sufficiently in advance of the expiration date.
Kimoun may send renewal reminders, but the absence of a reminder does not release the Client from its obligation to monitor and validate the renewal.
Kimoun may refuse a renewal in case of unpaid invoices, dispute, incomplete information, breach of these ST, technical impossibility or refusal by the registry or registrar.
10.2 Expiration, suspension, deletion and loss
In case of non-renewal, unpaid invoices, failure to validate or breach of applicable rules, the domain name may be suspended, deactivated, placed in quarantine, deleted or lost.
Depending on the extension concerned, restoration may be possible for a limited period, with specific fees.
Kimoun does not guarantee the possibility of recovering an expired, deleted, blocked, transferred or third-party-reserved domain name. The Client acknowledges that the loss of a domain name may be permanent.
10.3 Transfers
The Client may request the incoming or outgoing transfer of a domain name, subject to the rules of the extension, registry and registrar concerned.
The Client must provide the necessary information, in particular the authorisation code, the Registrant’s validation, the unlocking of the domain and the settlement of amounts due.
Kimoun does not guarantee the success of a transfer when the domain is locked, expired, in dispute, subject to a restriction, to a procedure, to a regulatory delay, or when the information provided is inaccurate or incomplete.
Transfer operations may be invoiced separately if they are not included in the initial offer.
Article 11 — Price and commercial conditions
Prices are indicated in euros, in net amounts. VAT not applicable, Article 293 B of the French General Tax Code.
Prices, discounts, included services, commercial gratuities, promotional offers or specific terms are indicated in the Quote, the contract, the registration order or the invoice.
When Kimoun includes a domain name, a renewal or a DNS service in a broader commercial offer, the limits, eligible extensions, eligibility conditions, exclusions and applicable durations are specified in the Quote or specific terms.
Unless otherwise stated, premium domains, restoration fees, dispute fees, transfer fees, fees imposed by a registry or registrar, urgent services and paid options are excluded from included or promotional offers.
No included offer, discount or commercial gratuity gives rise to refund, financial compensation or credit if the Client does not make use of it.
Article 12 — Payment
12.1 Prior payment
Unless otherwise agreed in writing, Kimoun may subject any registration, renewal, transfer, restoration or DNS intervention to prior payment of amounts due.
Kimoun is not required to advance fees due to registries, registrars or third-party providers on behalf of the Client.
12.2 Payment terms
Payment is due according to the terms indicated in the Quote, the contract or the invoice. Payment is made by bank transfer, unless otherwise agreed.
12.3 Consequences of late payment
Any late payment may result, without prejudice to amounts still due, in:
- suspension of order processing;
- suspension of ongoing services;
- refusal of a renewal;
- termination of services;
- application of late payment penalties at the rate indicated on the invoice or Quote, and failing this at the legal rate of three times the legal interest rate;
- the fixed legal indemnity for recovery costs of €40, pursuant to Article L.441-10 of the French Commercial Code;
- the invoicing of additional recovery costs where the actually incurred costs are higher.
Article 13 — Support and complaints
13.1 Standard support
Standard support is provided by email at oliver@kimoun.com. Unless otherwise agreed in writing, support is provided during usual business days and hours.
Standard support does not include urgent interventions, on-call services, audits, specific developments, legal services, disputes or interventions on third-party services not managed by Kimoun.
13.2 Complaints
Any complaint must be addressed by email to oliver@kimoun.com and specify:
- the identity of the Client;
- the domain name concerned;
- the order or invoice reference;
- a description of the problem;
- supporting documents useful for analysis.
Kimoun shall endeavour to respond within a reasonable timeframe.
Article 14 — Specific obligations of the Client
In addition to the general obligations of the Client, within the framework of these ST, the Client undertakes to:
- provide accurate, complete and up-to-date information;
- respond to validation requests within the agreed deadlines;
- settle amounts due;
- monitor important due dates;
- comply with the rules of registries, registrars and extensions;
- not use the services for illicit, fraudulent, abusive or malicious purposes;
- inform Kimoun without delay of any anomaly, dispute, change of information or suspected compromise;
- preserve the confidentiality of its accesses, identifiers, authorisation codes and sensitive information.
Article 15 — Prohibited uses
The Client shall not use the services provided by Kimoun to:
- usurp an identity;
- commit fraud;
- engage in phishing;
- send spam;
- distribute malicious software;
- circumvent security measures;
- host, redirect or promote manifestly illicit content;
- infringe third-party rights;
- harm the image, security or infrastructure of Kimoun or its providers.
In case of manifestly illicit, abusive, dangerous or non-compliant use, Kimoun may suspend all or part of the services, without notice where urgency or security so requires.
Article 16 — Security and access
Kimoun implements reasonable measures to ensure the security of the services provided. The Client remains responsible for the security of its own equipment, accounts, accesses, passwords, providers, websites, servers and third-party services.
The Client must promptly report any suspected compromise, usurpation, diversion, information leak or unauthorised use.
Article 17 — Suspension and termination
Kimoun may suspend or terminate all or part of the Services in case of:
- unpaid invoices;
- breach of these ST or of the GTC;
- abusive, fraudulent, dangerous or illicit use;
- false, incomplete or non-updated information;
- failure to respond to an important request;
- threat to security;
- decision by a registry, registrar, court or competent authority.
Termination does not give rise to refund of fees already incurred, services already performed, periods already started or amounts due to third parties, unless otherwise agreed in writing or required by mandatory legal provision.
Article 18 — Liability
18.1 Best-efforts obligation
Kimoun is bound by a best-efforts obligation, unless otherwise agreed in writing.
18.2 Specific exclusions
Kimoun shall not be held liable:
- for the choice of domain name by the Client;
- for any infringement of third-party rights resulting from such choice;
- for any refusal, blocking or withdrawal by a registry or registrar;
- for any unavailability of the domain before confirmation of registration;
- for any expiration, suspension or loss due to unpaid invoices, failure to validate or erroneous information;
- for any DNS propagation delay;
- for any failure or decision attributable to a third-party provider;
- for any misuse of services by the Client;
- for any indirect damage;
- for any loss of revenue, clientele, image, data or opportunity.
18.3 Liability cap
For professional Clients, Kimoun’s total liability, all damages and all causes combined, is limited to the amount effectively paid by the Client for the relevant service over the twelve (12) months preceding the triggering event.
This limitation does not apply in case of gross fault, wilful misconduct, bodily harm or any contrary mandatory legal provision.
Article 19 — Personal data and third-party providers
19.1 Reference to the General Terms and Conditions
The processing of personal data by Kimoun is governed by Article 5 of the General Terms and Conditions of Kimoun. The provisions below specify the particularities of the Services related to domain names and DNS management.
19.2 Data processed within these Services
Within the framework of the Services, Kimoun may process personal data relating to the Client, the Registrant of the domain, and administrative, technical or billing contacts. Such data may be necessary for:
- the registration and renewal of the domain name;
- DNS management;
- support;
- invoicing;
- compliance with legal obligations;
- the satisfaction of requests from registries and registrars.
19.3 Transfers to third parties
Some data may be transmitted to registries, registrars, DNS providers, hosts, email providers or technical providers, including outside France, depending on the extension and the provider used.
The Client warrants that it has the necessary authorisations when transmitting to Kimoun data concerning third parties (registrants, technical contacts, administrative contacts).
19.4 Technical subcontracting
The Client authorises Kimoun to engage the third-party providers necessary for the execution of the Services, in particular: registries, registrars, DNS providers, hosts, email providers, monitoring tools, security providers, billing providers or support providers. This authorisation supplements the provisions of Article 7 of the GTC.
Kimoun remains responsible for the proper performance of its own contractual obligations, without being held liable for the decisions, rules, unavailability, refusals or incidents attributable to registries, registrars or third-party providers when they fall outside its reasonable control.
Article 20 — Force majeure (reference to the General Terms and Conditions)
The provisions of Article 6 of the General Terms and Conditions of Kimoun apply in full to these ST. The following events in particular constitute events of force majeure, without this list being exhaustive:
- a general internet outage;
- a large-scale cyberattack;
- a failure of a registry, registrar, DNS provider, host or third-party service;
- an administrative or judicial decision affecting the Service;
- an external technical blockage imposed by an operator.
Article 21 — Language and translation
These ST are drafted in French. An English translation may be provided for informational, courtesy and convenience purposes for English-speaking Clients.
In case of divergence, ambiguity or contradiction between the French version and its English translation, the French version shall prevail alone and constitutes the contractual reference text.
Article 22 — Archiving and evidence
Email exchanges, Quotes, registration orders, contracts, invoices, confirmations, technical logs and management data may be used as evidence.
The Parties acknowledge the validity of email validations, scanned handwritten signatures and electronic signatures, subject to applicable legal rules.
Article 23 — Articulation with the General Terms and Conditions of Kimoun
These ST are read in conjunction with the General Terms and Conditions of Kimoun (GTC), which remain applicable for all universal provisions not covered here, in particular:
- confidentiality (Article 4 of the GTC);
- personal data protection, supplemented by Article 19 of these ST (Article 5 of the GTC);
- force majeure, supplemented by Article 20 of these ST (Article 6 of the GTC);
- subcontracting, supplemented by Article 19.4 of these ST (Article 7 of the GTC);
- assignment of contract (Article 8 of the GTC);
- modification of the GTC (Article 9 of the GTC);
- no waiver and severability (Articles 10 and 11 of the GTC);
- amicable resolution, applicable law and competent jurisdiction (Article 12 of the GTC).
In case of contradiction between these ST and the GTC, these ST shall prevail.
